AUP - Acceptable Use of Services Policy
Terms and conditions to be respected
The Acceptable Use of Services Policy (hereinafter referred to as “AUP”) sets out the rules for the use of the Services contracted with SUNWARE. You agree that You as a Client and Your users will use the Services in compliance with the Service Supply Agreement and this AUP.
By using the contracted Services you agree that:
- You will not engage in activities that fall within the scope of the law;
- You will not transmit unsolicited or bulk emails. You will not use the Service to engage in Spam or Mail Bombing;
- All emails sent using the Service that will contain commercial or advertising messages must include an opt-out option for the recipient;
- You will not unauthorizedly make, access, or access SUNWARE’s or any other party’s websites, servers or hosting accounts;
- You will not allow, or accept remote execution of applications, scripts with malicious content using the Contracted Service;
- You will not forge signatures, you will not engage in identity theft activities;
- You will not harm or seek to harm minors in any way;
- You will not store information, content, audio, video, pictures with child pornography;
- You will not host or operate audio or video streaming services;
- You will not host sites that use cryptopools/continue mining scripts, promote cryptocurrency money making schemes, crypto exchange or crypto airdrop;
- You will not use the contracted Services to store websites, content, links to:
- Content that infringes intellectual property rights, patents, trade secrets or trademarks and any other rights of a third party;
- Promotes hatred or insults against a person or ethnic, social, religious, etc. group;
- What contains viruses, Trojans, worms, worms, ramsomware, spyware, adware, adware, scareware, corrupted files, or any other software with malicious content or programs that may interrupt, limit the functionality of, or destroy any equipment, software or hardware;
- Illegal content or Warez (Hacking/Phreaking) software;
- Contains any commercial, copyrighted software freely distributed at no cost. This includes but is not limited to Mpeg Layer 3 (MP3) files;
- Contains any kind of proxy servers servers or any similar platform;
- Contains Torrent tracker, Torrent portals or any similar platform;
- Operates or contains any peer-to-peer platform;
- They include adult, pornographic, obscene, harassing or child abuse related content;
- Contains personal data, private information, images, photographs, video content or any material that allows the identification of a person, including children without their consent or, where appropriate, the consent of their parents in the case of minors;
- Contains any material, data that is abusive, false, threatening, harassing or defamatory;
- Fake, lying, manipulative news content;
- Contains any material that promotes or supports violent or terrorist activities.
The following are examples of non-limitative content, materials, websites are prohibited on all SUNWARE servers: IRC Bots, Proxy Scripts, Warez, Sites that promote banned substances, AutoSurf Sites, IP Scanners, Brute Force Programs, Mail Bombers and SPAM scripts, sites that promote illegal activities or any other sites that promote warez content.
Any material that in our reasonable opinion is obscene or threatening will be immediately blocked and removed from our servers.
By using the Services contracted with SUNWARE you agree not to engage in or instigate activities that may harm or affect SUNWARE, or any SUNWARE customer or any other third party. Such actions include, but are not limited to, blacklisting of SUNWARE IPs by any online anti-spam platform or affecting the reputation of IPs, or actions resulting in DOS attacks on SUNWARE servers, etc.
You, a representative/employee of yours, a partner (legal entity or natural person) or a representative/employee of a partner is involved in personal name or as a legal representative in activities that may damage the rights or reputation of SUNWARE.
You are solely responsible for ensuring that the programs and scripts installed or used as part of the Contracted Service are secure and that the files and/or directories have the correct permissions configured. You are responsible for any activities or actions when using the Service including compromising authentication data. You agree to keep your data secure at all times. We reserve the right to periodically perform security audits of access credentials. To the extent that we determine that authentication credentials (to email, ftp, Customer Account) have been compromised or are at risk of being compromised, we will reset those credentials as appropriate or suspend access to the Customer Account, Server or the entire Service. To the extent that such actions are taken on the Service we will notify you by email at the address associated with the Customer Account.
We reserve the right to terminate any Contract that is suspended for breach of the AUP or PTM, without the right to refund any amounts paid.

This AUP is an integral part of the Service Supply Contract “TOS”.
